Terms and conditions — Studio Bartholomeus Versie / Version 1.0 · 28 October 2026 Studio Bartholomeus Leersum · KvK 42019706 · VAT ID NL005439155B86 · info@bartholomeus.studio 1. Who we are Studio Bartholomeus is a trading name of the sole proprietorship Bas Bartholomeus. These terms concern design, bespoke work, manufacture, delivery and installation under Studio Bartholomeus. Business and contact details appear above. 2. Definitions The client receives a quote or commissions work. A consumer acts outside a trade or profession; other clients are business clients. A quote describes the work, price and agreed arrangements. A commission is formed when the client accepts the quote. The design phase includes agreed sketches, drawings, models and samples. 3. Application These terms apply only when Studio Bartholomeus provides them and declares them applicable before the contract is concluded. Specific arrangements in the quote take precedence. A business client’s terms apply only if expressly accepted in writing. Version 1.0 applies to new quotes supplied with this version. Existing quotes and commissions are not changed retrospectively. When a new quote carrying these terms is digitally accepted, the terms version and time are recorded. 4. Quotes and acceptance Any validity date is stated in the quote. There is no general 30-day validity period. Without an agreed period, the statutory rules on offers and acceptance apply. The expiry of a personal portal link is separate from quote validity. A working link does not extend an agreed quote deadline. A commission is formed by acceptance in the portal, by email or in writing. Changes after acceptance require a new agreement. I will contact the client to correct an obvious error in a quote. Statutory protection of the client’s legitimate reliance remains unaffected. 5. Prices and included work Consumer prices include 21% VAT. Business quotes distinguish prices excluding and including VAT. Each project and quote explicitly states what is included: design, materials, manufacture, delivery and installation where applicable. There is no general promise that delivery or installation is always included or always excluded. A starting price concerns the described basic specification. Separately charged work, such as delivery, travel time, installation or site adjustments, is agreed beforehand with the calculation method and an estimate. Hourly work includes an agreed hourly rate. No fixed delivery rate or mileage charge applies automatically. For a sauna, the quote also states whether foundations, site preparation and any electrical connection are included, arranged by the client or quoted separately. Self-installation changes the price only if agreed beforehand. Additional work is discussed in advance and is carried out and charged only after agreement on its description and price or estimate. Unforeseen urgent measures are governed by law and the client is informed as soon as possible. 6. Design and files Design is paid work. Scope, fee, included revisions and additional hours are agreed beforehand. If the commission proceeds, the design fee is credited against its total: the same work is not charged twice. Copyright and other intellectual property rights in my own designs, drawings and 3D models remain with Studio Bartholomeus insofar as those rights exist. The client receives the agreed work; editable source files and transfer of rights are not automatically included. Source-file delivery and permitted use are agreed separately in writing when required. Delivering a file does not transfer copyright. Viewing models in the portal is part of the agreed service. 7. Measurements and information I normally take measurements myself. Clients may supply their own measurements. We record who measured and which measurement version was approved. The client is responsible for the accuracy of information they supply. I warn of errors or unsuitable assumptions that I should reasonably identify. My responsibility for my own measurement and execution errors remains. We first discuss the consequences of incorrect client information. Remedial and additional work requires agreement before execution and charging. 8. Payment Unless expressly agreed otherwise in the quote, 50% is invoiced on acceptance and 50% on completion. Each invoice is payable within 14 days of its date. Invoicing on acceptance does not mean immediate payment is required. If work starts only after receipt of a deposit, this is stated beforehand in the quote and schedule. In a consumer sale, no more than half the purchase price is required as advance payment. Mandatory law always takes precedence. Late payment is followed by a reminder. Consumer collection costs are charged only in accordance with statutory rules, after a free notice allowing the legally required 14-day period following receipt. 9. Delivery time and planning A stated delivery time is an estimate unless a fixed deadline is expressly agreed. Planning is coordinated with the client and maintained in the portal where applicable. If delay is likely, I inform the client promptly with the reason and a revised estimate. An estimate does not allow unlimited postponement. Statutory rights in the event of late delivery remain. 10. Delivery, installation and completion Delivery and installation follow the quote. The client ensures the site is accessible and suitable as agreed beforehand. Any difficulty is discussed. We inspect the work together on completion. Outstanding items are recorded and addressed within a reasonable time. Risk passes in accordance with law; in consumer sales, normally only when the consumer or their designated third party receives the product. 11. Withdrawal and cancellation For consumers concluding a distance or off-premises contract, the statutory withdrawal period applies unless a statutory exception applies. Normally this is 14 days after receipt of goods, or 14 days after conclusion of a service contract. Before acceptance I explain which rules apply. Goods made to the consumer’s individual specifications or clearly personalised may fall within the statutory bespoke-goods exception. This does not automatically exclude withdrawal for a separate design service or every phase of a commission. A service begins during the withdrawal period only at the consumer’s express request. Following withdrawal, a proportionate fee for work already performed may be due if the statutory information and consent requirements were met. Withdrawal rights for a fully performed service end only under the statutory conditions, including prior express consent and acknowledgement of the loss of that right. Withdrawal requires no reason and can be notified through the Withdraw from a contract form on this website or by email to info@bartholomeus.studio. Include your name and identify the contract. The statutory model form may also be used but is not compulsory. Electronic notices are acknowledged. Following a valid withdrawal, refunds due are made within the statutory 14 days after notice, using the original payment method unless otherwise agreed. For goods, repayment may be withheld until receipt of the return or evidence of dispatch where the law permits. Goods must be sent back within 14 days after withdrawal notice. Consumers pay return costs only if correctly informed before contracting; otherwise I bear those costs. Cancelling or terminating an agreed commission differs from exercising a withdrawal right. Outside a valid withdrawal, I reasonably charge for work and design time performed and material or other costs that can no longer be cancelled, less savings and reasonably reusable materials. There is no fixed cancellation percentage or double charging. An itemised account is provided. To the extent that law would allow a higher amount, this agreement adopts this more limited settlement. 12. Conformity and service The work must meet what the client may reasonably expect under the contract, including normal use. Statutory conformity rights and evidential rules remain fully applicable. There is no fixed additional commercial guarantee unless the quote provides one. Reported defects are assessed carefully. Where I am responsible, repair, replacement or another statutory remedy follows. Normal wear, misuse or failure to perform specified maintenance may fall outside my responsibility, without excluding statutory rights. Wood is a natural material. Colour, grain and limited movement caused by moisture and temperature may be inherent. Whether an attribute is a defect depends on the specific contract and the client’s reasonable expectations. 13. Liability Statutory liability applies to consumers. These terms do not limit their statutory rights. Any liability cap or other limitation for business clients must be expressly agreed in the individual quote. These general terms impose no automatic amount, no limit to the contract price and no link to an insurance payout. Without a separately agreed limitation, statutory rules apply. A limitation does not apply where mandatory law prevents it, or in the event of intentional misconduct or conscious recklessness by Studio Bartholomeus. Please report damage promptly so it can be assessed and limited. 14. Retention of title Delivered goods remain my property until the agreed amounts for those goods have been paid, insofar as law permits. Incorporation into a building or another item may transfer ownership by law, after which retention may no longer apply to that part. Recovery requires the client’s cooperation or lawful legal measures. This gives no right to enter a home or dismantle items without consent. 15. Photography and publication I preferably photograph work in the workshop or as non-identifiable product details. Photography at a client’s premises and publication require separate prior arrangements. The client may refuse permission without affecting the commission. Identifiable people, addresses and other private information are not published without express permission. 16. Personal data Personal data is processed as described in the privacy policy at bartholomeus.studio/privacy. Consent to a newsletter, attribution cookie or publication of photographs is separate from the commission. 17. Complaints and disputes Complaints may be sent to info@bartholomeus.studio with a description and photographs where possible. I work with the client towards a suitable solution. This reporting route does not limit statutory rights or deadlines. Dutch law applies. For consumers outside the Netherlands, mandatory protective rules remain applicable where required by law. Disputes go to the court with jurisdiction under the law; these terms do not impose an exclusive choice of court. 18. Later versions A later version has its own number and date and applies only to new quotes where it is provided and agreed beforehand. Earlier quotes, approvals and ongoing work remain subject to the previous arrangements. The Dutch text is the original; mandatory consumer rights always remain applicable.
